OFFICIAL RULES

NO PURCHASE OR TRANSACTION NECESSARY TO ENTER OR WIN

SWEEPSTAKES PERIOD:
The United Commercial Bank (“UCB”) Eco-Green Sweepstakes Promotion is valid from October 23, 2009 through December 31, 2009 (the “Sweepstakes Period”).  All the mail-in entries must be post-marked and received no later than December 31, 2009 by UCB.

PRIZE:
SWEEPSTAKES GRAND PRIZE:  One Honda Insight LX1(approximate retail value is
$20,000.00)
Second Prizes:  Solar Powered Backpacks (2 winners)
Third Prizes:  Casio Solar G-Shock Watches (5 winners)
Special Prizes:  Solar Powered Flashlight Radio (30 winners)

Each winner is eligible for one prize only from the prizes listed above, higher prize value will prevail.  All entries will be compiled from all eligible valid entries received during the Sweepstakes Period. Winners will be drawn by UCB personnel at UCB Headquarters located at 555 Montgomery St., San Francisco, CA 94111 on February 16, 2010 at approximately 10:00 AM (PT).  

All properly claimed prizes will be awarded “as is” with no warranty or guarantee, whether express or implied by UCB. No prize transfers, substitutions or cash redemption permitted.  UCB reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at their sole direction.

All federal, state, and local taxes on prizes are the winner’s responsibility.  The winner will be required to provide his or her United States social security number or any other relevant governmental tax information for tax purposes.  Any additional expenses not stated are solely the responsibility of the winner.

Note:

1. Purchase cost with sales tax will be paid by UCB. Winner is responsible for all other costs associated with the ownership of the car.

ELIGIBILITY:

1. No purchase or transaction is necessary to enter or win. Purchase or transaction will not improve chance of winning. 
2. The Sweepstakes is open to all legal residents of United States aged 18 or older.
3. There is no limit to the number of eligible valid entries submitted.  However, only one submission per stamped envelope will be accepted.
4. Entrants/participants are responsible for their own postage when submitting entries.
5. Employees of UCB and members of their immediate family (spouses and parents, siblings, children and each of their spouses regardless of where they live), their affiliates, subsidiaries, advertising agencies, or any other company involved with the design, production, execution or distribution of the Sweepstakes are not eligible to enter or win.
6. All applicable federal, state and local laws and regulations apply. Void where prohibited by law.
7. This Sweepstakes may be terminated, withdrawn or modified at any time as necessary to comply with legal requirements in any jurisdiction or due to any invalidation by reasons of printing, typographical or mechanical errors, without prior notice to participants in the Sweepstakes.
8. Entries received or postmarked after the Sweepstakes period will not be entered into the drawing.
9. The odds of winning are dependent upon the total number of eligible drawing entries received.

HOW TO ENTER:
There are several ways to enter this Sweepstakes:

1. Participants are automatically entered when you open a qualified account2 at any UCB branch during the “Sweepstakes Period.”  In addition, you will also receive a premium gift of a “Stainless Steel Water Bottle” as a welcome gift from our bank with a minimum opening balance of $500 in new funds.  This promotion is only available to consumer accounts.  “Qualified Accounts” are namely: 
1. Interest and Non-interest Bearing Checking Accounts  (10 entries)
2. Savings Account  (5 entries)
3. Money Market Account  (5 entries)
4. Certificates of Deposit Account (2 entries)
5. IRA Account (2 entries)

1. Existing UCB customers qualify for Ten (10) Sweepstakes entries when you sign up for the following banking service during the “Sweepstakes Period”:

Enter without purchase or transaction:  Participants can enter the Sweepstakes by legibly hand-printing name, complete mailing address, phone, birth date, email address (if available), and specifying if the participant is a UCB customer on a 3” x 5” paper.  The entry form should be placed in a sealed, stamped and hand printed #10 envelope and mailed to:

An eligible valid entry is defined when all Official Rules on ‘How to Enter’ Section are specifically followed and postmarked within the “Sweepstakes Period.”  Each entry must be mailed separately and postmarked no later than December 31, 2009.  Entries received after the Sweepstakes Period will not be entered into the drawing. Only one submission per stamped envelope will be accepted. The odds of winning are dependent upon the total number of eligible drawing entries received.

Note:

1. Qualified Accounts include SmartOne Free Checking Account, Signature Checking Account, Premium Checking Account, Easy 1+1 Account, Advantage 1+1 Account, Statement / Passbook Savings Account, United Premium Savings Account, United Advantage Savings Plan, Gold Money Market Account, Relationship Gold Money Market Account, Certificates of Deposit, Retire Plan Accounts.   Each product has a different minimum balance requirement and the standard Supplemental Terms and Conditions applies.  Refer to the Supplemental Terms and Conditions of the respective accounts, and the Fee Schedule for Consumer Accounts for details. Customer will receive a stainless steel water bottle at account opening with a minimum opening deposit of $500 in new funds.
2. UCB will calculate the total deposit amounts made in the checking or the savings account within the Sweepstakes Period and subtract the total withdrawal amounts made during the same period.  Total entries will be granted based on the increment of $1,000 net growth in deposits.  Entrants can not receive more than 50 entries per checking or savings account.  The United Advantage Savings Plan (UASP) is excluded. 

WINNER NOTIFICATION:
Winners will be notified by mail. If a prize notification is returned as undeliverable, the prize will be awarded to an alternate winner. Winners will have 14 DAYS from notification (noted by postmark on the certified mail) to claim the prize. Failure to comply may result in disqualification and the selection of an alternate winner.  Winner will be required to sign and return, when requested, an Affidavit of Eligibility, Liability, and Publicity Release, except where prohibited by law, which must be returned within 14 days of notification, or the prize will be forfeited and an alternate winner will be selected in a separate random drawing.  Winner must present a valid picture identification (i.e. a driver’s license or passport) to redeem the prize.

MISCELLANEOUS:

1. By entering the Sweepstakes, entrants agree to abide and be bound by all the terms and conditions of the Official Rules (“Official Rules” or “rules”) and all decisions of UCB, whose decisions are final.  UCB shall be deemed as sole interpreter of the Official Rules.
2. Entrants agree to release, discharge, and hold harmless UCB from all claims or damages arising out of an entrant’s participation in the Sweepstakes and/or acceptance and/or use of any prize.
3. By acceptance of a prize, the winner agrees to have his/her name, likeness, city and state published by UCB, except where prohibited by law (with no additional compensation provided), as determined by UCB in its reasonable discretion. Name of the winner will be posted on UCB’s website at www.ibankunited.com. Also, Winner, by acceptance of the/a prize, agrees to release UCB, its parent, subsidiary, and affiliated businesses, and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives and any other person or entity associated with this Sweepstakes from any and all liability claims or actions of any kind whatsoever for injuries, damage or losses to persons and property which may be sustained in connection with the receipt, enjoyment, ownership or use of the prize.  UCB expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent of any prize awarded.
4. UCB bears no responsibility for entries or mail that are lost, stolen, late or misdirected.  Entries that are incomplete or contain errors will be disqualified. If for any reason the Sweepstakes is not capable of running as planned, UCB reserves the right to terminate, cancel or suspend the Sweepstakes.
5. If there is evidence of tampering, unauthorized intervention or fraud, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, UCB reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process and/or to cancel, terminate, modify or suspend the Sweepstakes. 
6. All submissions become the property of UCB and are subject to the privacy policy of UCB located at http://www.ibankunited.com/ucb/home.html. You may be asked to consent to the receipt of information and marketing materials from UCB.  Consenting to receive information and marketing materials is optional and does not improve your chances of winning.  You may opt out of the receipt of information and marketing materials from UCB at any time. 
7. This Sweepstakes is governed by the laws of the State of California.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant/entrant and UCB in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of California.  
8. Each entrant/participant agrees that any and all disputes, claims and causes of action arising out of, or in connection with, this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and any and all claims, judgment and awards shall be limited to actual out of pocket costs incurred, including costs associated with this Sweepstakes, but in no event attorneys’ fees and under no circumstances will entrant/participant be permitted to obtain awards, and entrant/participant waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out of pocket cost, and any and all rights to have damages multiplied or otherwise increased.
9. If the participating UCB account is closed before 12/31/2009, all the entries associated with this account will be forfeited.
